These General Terms & Conditions apply to order requests submitted through the Viktoriia Dessert website.

By submitting an order request, you confirm that you have read and accepted these General Terms & Conditions.

2. Products

Viktoriia Dessert offers handmade desserts prepared in small batches and, where applicable, made to order.

As our products are handmade, minor variations in colour, shape, decoration and appearance may occur. Such variations are a natural characteristic of handcrafted products and do not constitute a defect.

Product photographs are for illustrative purposes. We aim to reproduce the appearance shown on the website as accurately as possible while allowing for reasonable variations resulting from handmade production.

3. Order Requests and Confirmation

Orders can be requested through the website, subject to product availability and our capacity to fulfil the requested order.

Submitting an order request through the website does not automatically constitute acceptance of the order.

After submitting an order request, you will receive an automatic email confirming that your request has been received. This email confirms receipt of the request only and does not mean that the order has been accepted.

We will review the request and, where possible, confirm the order separately by email.

An order is considered accepted only once Viktoriia Dessert has sent a separate order confirmation.

We reserve the right to decline an order request where, for example, the requested date, product, quantity, customisation or delivery arrangement cannot be accommodated.

4. Customisation

Customers may include requests for custom colours, decorations, flavours or other modifications when submitting an order request.

Customisation requests are subject to availability and must be individually confirmed by Viktoriia Dessert.

A requested customisation is not considered agreed until it has been confirmed by Viktoriia Dessert.

Because our products are handmade, the final result may contain reasonable variations from the requested design while maintaining the agreed overall style and specifications.

5. Prices and Payment

All prices displayed on the website are stated in euros (€).

The applicable price is the price displayed at the time the order request is submitted, unless a different price is agreed for a custom request.

Payment is currently made upon pickup or delivery.

No online payment is required when submitting an order request.

For certain large, custom or event orders, Viktoriia Dessert may require a deposit or advance payment. If applicable, this requirement will be communicated to the customer before the order is confirmed.

6. Pickup

Pickup is available by appointment only.

Customers may indicate their preferred pickup time when submitting an order request. Preferred pickup times are subject to availability and are only confirmed once Viktoriia Dessert confirms the order.

There are no fixed public opening hours for pickup.

If you are unable to collect your order at the confirmed time, please contact us as soon as possible. We will do our best to arrange an alternative pickup time, subject to availability.

Once an order has been collected, the customer is responsible for transporting and storing the products appropriately.

7. Delivery

Delivery may be requested when placing an order.

Delivery is subject to availability and is not guaranteed until it has been separately confirmed by Viktoriia Dessert.

Delivery availability, delivery fees and available time slots may vary depending on the delivery address, distance and our availability.

Customers should provide a complete and accurate delivery address and indicate their preferred delivery time where possible.

The final delivery arrangements, including any applicable delivery fee and time window, will be confirmed by email before the order is considered accepted.

Once the order has been delivered, the customer is responsible for storing and handling the products appropriately.

8. Storage and Consumption

Our desserts are fresh and perishable products and must be stored according to the storage instructions provided for the relevant product.

Unless otherwise stated on the relevant product page, all desserts must be kept refrigerated at 2–7°C.

Specific storage conditions and recommended consumption periods are indicated on the relevant product page on our website and may also be provided with the order.

Customers are responsible for following the recommended storage conditions and consumption period after collection or delivery.

Once an order has been collected or delivered, Viktoriia Dessert cannot be held responsible for deterioration or damage caused by improper storage, transportation or handling by the customer.

For the best quality and safety, customers should refrigerate the desserts as soon as possible after collection or delivery and avoid leaving them at room temperature for extended periods.

9. Allergens and Food Information

Information about ingredients and allergens is provided on the website and/or with the order.

Customers are responsible for checking the allergen information before placing an order and should contact us if they require clarification about a particular product.

Our products are prepared in a kitchen where various allergens may be present. While we take appropriate precautions to minimise cross-contamination, we cannot guarantee that our products are completely free from traces of allergens.

Customers with severe allergies should contact us before placing an order.

10. Cancellation and Changes

For regular orders, cancellation requests should be submitted at least 24 hours before the confirmed pickup or delivery time.

For custom or personalised orders, cancellation requests should be submitted at least 72 hours before the confirmed pickup or delivery time.

Cancellation requests received after these deadlines may not be accepted, particularly where preparation of the order has already started.

Requests to change products, quantities, flavours, decorations or other order details are subject to availability and may not be possible once preparation has started.

11. Right of Withdrawal

The statutory right of withdrawal does not apply in certain circumstances provided for by applicable consumer law, including certain contracts concerning goods that are liable to deteriorate or expire rapidly and goods made to the consumer's specifications or clearly personalised.

Where a statutory right of withdrawal applies, the customer will be informed of the applicable conditions.

12. Complaints and Incorrect or Damaged Orders

We want every order to arrive in excellent condition.

If you believe that your order is incorrect, damaged or defective, please contact us as soon as possible after receiving or collecting it and provide a description of the issue and, where relevant, photographs.

We will assess the situation and, where appropriate, provide a suitable solution in accordance with applicable consumer law.

13. Liability

Viktoriia Dessert is responsible for providing products that conform to the confirmed order and applicable legal requirements.

We cannot be held responsible for damage or deterioration resulting from improper storage, transportation or handling after the order has been collected or delivered.

Nothing in these Terms & Conditions limits any rights or protections that consumers have under mandatory Belgian or European consumer law.

14. Intellectual Property

All photographs, text, designs, logos and other content displayed on the Viktoriia Dessert website are the property of Viktoriia Dessert or are used with permission.

They may not be copied, reproduced, modified or used for commercial purposes without prior written permission.

15. Privacy

Personal information provided when submitting an order request is processed in accordance with our Privacy Policy.

16. Applicable Law

These General Terms & Conditions are governed by Belgian law.

Nothing in these Terms & Conditions affects the mandatory rights granted to consumers under applicable Belgian and European consumer protection legislation.
